Terms of Service

1. Agreement

These Terms of Service are an agreement between you and BLUR TEC LLC, a New York limited liability company (“Blurtec,” “we,” “us,” or “our”). They apply to outward.dev, the Outward macOS application, related websites, and services (collectively, the “Service”).

By downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service for a company or other organization, you represent that you have authority to bind it, and “you” includes that organization.

2. Eligibility and accounts

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian. The Service is not directed to children under 13.

You are responsible for providing accurate account information, keeping your sign-in methods secure, and all activity under your account. You must notify us promptly at contact@outward.dev if you believe your account or device session has been compromised. We may require re-authentication or revoke sessions to protect the Service.

3. The Service and local data

Outward is designed as a local-first macOS application. Project content such as notes, terminal content, project files, canvas arrangements, stack nodes, and locally stored bookmarks is stored on your Mac and is not uploaded to Blurtec for general cloud storage under the current Service design.

Some account, authentication, security, crash-reporting, and analytics information may be processed outside the app as described in our Privacy Policy. Features may change, be added, or be removed. We do not promise that any particular feature will remain available or that the Service will always be uninterrupted.

You are responsible for your own backups. Local storage is not a substitute for a backup strategy, version control, or a disaster-recovery plan.

4. Free tier and subscriptions

The Free plan includes one project. Outward Pro includes unlimited projects and costs $9.99 USD per month or $89 USD per year, plus applicable tax. We may change plan features or prices prospectively, but the price and billing interval shown in Stripe's hosted checkout control the subscription you authorize.

Outward Pro renews automatically for the same billing interval until canceled. You can manage or cancel it from Settings › Plan in Outward, which opens Stripe's customer portal. Cancellation normally takes effect at the end of the current paid period, so Pro access continues until that period ends. Canceling does not automatically refund unused time.

You authorize Stripe to charge the selected payment method for the subscription price, applicable taxes, and other amounts disclosed before purchase. If a payment fails, Stripe may retry it and send recovery notices. We may restrict or downgrade Pro features after the subscription expires or is canceled following failed recovery. Your local project data is not deleted when access changes, but projects above the Free plan limit remain locked until you resubscribe or return to the limit.

We offer a voluntary full refund when requested within 14 calendar days after an initial or renewal charge. An approved full refund ends the related subscription and Pro access immediately. To request one, follow our Refund Policy. This policy does not limit any non-waivable rights under applicable law.

Deleting your Outward account cancels active subscriptions and ends paid access immediately. Account deletion does not automatically refund unused time, but you may request a refund under our Refund Policy or exercise any additional right provided by law. You never need to contact support or cancel a subscription before deleting your account.

5. License to use Outward

Subject to these Terms, Blurtec grants you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Service on devices you own or control for lawful personal or commercial work.

You may not copy, sell, rent, sublicense, distribute, modify, reverse engineer, decompile, disassemble, bypass technical restrictions, or attempt to extract source code from the Service except to the extent a restriction is prohibited by applicable law. You may not use the Service to build a competing product, interfere with its operation, or access it through unauthorized methods.

6. Your content and feedback

You retain ownership of content you create, import, store, or arrange in Outward (“Your Content”). Because project content is designed to remain local, Blurtec does not claim ownership of it or a broad license to use it.

If you voluntarily send content to us—for example, in a support request—you grant Blurtec a limited, worldwide, royalty-free license to host, copy, and use that content only as reasonably necessary to respond, provide support, secure the Service, or comply with law. You represent that you have the rights needed to provide it.

If you send suggestions, ideas, or feedback, you grant Blurtec permission to use them without restriction or payment. Feedback does not include confidential project content unless you intentionally provide it.

7. Acceptable use

You may use Outward for lawful work, including commercial work. You may not use it to:

  • break the law, infringe another person’s rights, or violate a contract;
  • access, collect, or expose credentials, data, or systems without authorization;
  • distribute malware, ransomware, spyware, spam, or other harmful code;
  • harass, threaten, impersonate, defraud, or target another person;
  • probe, scan, overload, disrupt, or bypass security for the Service or another system;
  • use the Service to create or operate a high-risk system where failure could cause death, serious injury, or significant property or environmental damage; or
  • help another person do anything prohibited by these Terms.

8. Third-party services

Outward may connect to third-party services that you choose to use, such as identity providers, source-control services, social services, payment platforms, or links you add to your workspace. Those services are controlled by their own operators and terms. Blurtec is not responsible for their availability, security, content, or privacy practices.

When you connect a third-party service, you authorize the requests needed to provide the feature you selected. You are responsible for reviewing that provider’s terms and disconnecting it when you no longer want the connection.

9. Ownership and trademarks

The Service, including its software, design, text, branding, graphics, and documentation, is owned by Blurtec or its licensors and is protected by intellectual-property laws. These Terms do not transfer ownership to you. Outward, Blurtec, and related marks are trademarks of their respective owners. You may not use them without permission.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” BLURTEC DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, ACCURACY, AND QUIET ENJOYMENT.

Blurtec does not warrant that the Service will be uninterrupted, error-free, secure, compatible with every system, or capable of preserving every local file or session. You are responsible for evaluating whether Outward is appropriate for your use and for maintaining backups. The Service is a productivity tool, not legal, financial, medical, security, or other professional advice.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLURTEC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF BLURTEC FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID BLURTEC FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR US$100.

These limits do not apply to liability that cannot legally be limited or excluded.

12. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Blurtec and its affiliates, officers, members, employees, contractors, licensors, and service providers from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, Your Content, your violation of these Terms, or your violation of another person’s rights.

13. Suspension and termination

You may stop using the Service at any time. Blurtec may suspend or terminate access if you materially violate these Terms, create security or legal risk, fail to pay for a paid plan, or if we discontinue the Service. We will use reasonable efforts to provide notice when practical.

When access ends, your license to use the Service ends. Sections that should reasonably survive termination—including ownership, content rights, disclaimers, limitations of liability, indemnification, dispute terms, and general terms—will survive. Because project content is local, you are responsible for exporting or preserving it before uninstalling or deleting local app data.

14. Changes to these Terms

We may update these Terms as the Service, law, or business changes. We will post the updated version and change the “Last updated” date. If a change materially affects your rights, we will provide additional notice when required. Your continued use after the effective date means you accept the updated Terms.

15. General terms

New York law governs these Terms without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service must be brought in a state or federal court located in New York State, and you consent to that court’s jurisdiction, except where applicable law requires another forum.

These Terms and the Privacy Policy are the entire agreement about the Service and replace prior agreements on the same subject. If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Blurtec may assign them as part of a merger, sale, reorganization, or transfer of the Service.
